Yale tops Harvard with 21.9 percent investment return (Reuters)

(Reuters) ? Yale University's endowment earned a 21.9 percent investment return last year with foreign stocks and private equity investments fueling gains, the Ivy League school said on Wednesday.

The elite school said the endowment value rose to $19.4 billion, making it one of the richest in the world.

Due to large bets on private investments, real estate and hedge funds, the New Haven, Connecticut-based school put up slightly better returns than arch rival Harvard, which reported a 21.4 percent investment gain. Harvard's endowment remains much larger, however, at $32 billion.

Yale's investment process is closely watched in the asset management world as Chief Investment Office David Swensen helped nearly double the endowments size. Over the last decade, Yale's endowment has returned 10.1 percent per year, handily beating stocks' 3.9 percent gain and bonds' 5.1 percent gain.

The average return for college and university endowments was 6.2 percent during the last 10 years.

The university's foreign stock portfolio jumped 40.7 percent, while its private equity portfolio gained 30.3 percent, the university said.

Yale, like many top endowments selects outside managers to handle its investments. Harvard, by comparison, manages much of the money in house, but also lets outside investors oversee a big part of it.

South Korea is among the world?s most wired places. Seoul metro passengers stream KBO baseball games on their tablet PCs while native search companies Naver and Daum provide high-quality street views that outmatch the Google equivalent. High technology is at the heart of Korean industry and society; the country is renowned for its high-speed fiber-optic Internet connections, ubiquitous Wi-Fi networks, and relatively cheap unlimited data plans. And few nations have grappled as forcefully with the trade-offs between online security and online anonymity, having ditched the latter to strengthen the former. At least that was the theory before the bargain backfired spectacularly over the summer.

In late July, a malicious code infiltrated South Korea?s major portal site Nate and the social networking service Cyworld, the ?Facebook of Korea,? granting cyber attackers with an IP address originating in China access to some 35 million netizens? personal information. The attack, allegedly directed by North Korea, was the largest in the South?s history, more severe than the hacks in April that exposed the personal information of 425,000 Hyundai Capital users and paralyzed Nonghup?s banking system for days.

The attack on Cyworld shocked Koreans in a way that no online security breach has ever shocked Americans. This was not akin to a case of hackers gaining access to your embarrassing Facebook Chat conversations with an ex-girlfriend or tagged photos of you at last year?s New Year?s Eve party, or someone stumbling upon discrete information about one firm?s customers. No, thanks to Korea?s Real Name Verification and Cyber Insult Laws, enacted in 2008, those hacking Korea from outside made off with a treasure chest of critical information. July?s hackers accessed 35 million Internet users? names, cellphone numbers, e-mail addresses, social security numbers, passwords, occupations, office numbers, and blood types. In a country of 48 million that is still technically at war, the idea that nearly 100 percent of the online population?s private data is now in the hands of the enemy is more than a little disconcerting.

You can blame bullies?and not solely the ones in Pyongyang?for this turn of events. It was ?cyber bullying,? after all, that catalyzed the ratification of South Korea?s ?real name? verification system and Cyber Insult Law after the beloved actress Choi Jin-sil, a victim of malicious online gossip, hung herself in her bathroom in October 2008. Leading politicians from the ruling Grand National Party?no fans themselves of nasty, anonymous online commentary?rushed to limit unfettered, unattributed online speech. This was not a dissent-crushing despotic regime looking to control access to information, but rather one of Asia?s most vibrant democracies turning the nature of the Internet on its head.

The ?real name? verification policy requires extensive personal data as a prerequisite to accessing Web sites that receive more than 300,000 daily views on average. As a foreigner living in Seoul, the effects of this policy are immediately apparent. First, I have difficulty accessing Korean Web sites. This can be partially attributed to my use of an Apple computer with Chrome, Firefox, and Safari browsers (Korean Web sites are made for Internet Explorer, an odd quirk for such a high-tech society). My Korean language skills are also limited. But the key reason I was unable to purchase tickets for the Harry Potter finale online was my lack of a social security number and other essential personal information. It?s like being unable to get on a plane back home, for lack of identification.

With verified names attached to every online movement on all the major Korean sites, the government?s approach to the online universe is unusual. Could its national policy influence what is essentially a borderless medium? Could Korea?s clampdown on online anonymity spread?

It is too soon to tell for sure where the Korean experiment will end up, but there are reasons to believe that what Seoul imposes on its netizens is unlikely to undermine online users? privacy in Los Angeles. For one thing, Korea is a self-contained online cul-de-sac, with a deeply entrenched language that is hard on outsiders. Second, Korea has an extensive online business culture of its own. Facebook and Google face formidable domestic homegrown competition from the likes of Cyworld and Naver. Google commands only 2 percent market share, compared to Naver (68 percent), Daum (20 percent), and Nate (7 percent). Other online businesses beyond search are similarly dominated by domestic players. With users sticking to Korean Web sites instead of foreign-controlled ones, the government has more leverage to govern the online space.

Still, the brief history of the RNVL makes clear the limitations of centralized approaches to Internet policy in general, and of the Korean government?s specific efforts to affect the relationship between governments and the Web. Regulating content on the Web has proven difficult in open societies, if not seemingly impossible, and Korea is hardly alone in attempting to do so. The U.S. government still struggles to prevent illegal file-sharing within its borders, a decade after the landmark Napster vs. A&M Records court case. Anyone proficient in Googling can figure out how to download a Bob Dylan box set in 15 minutes.

Governments seek to maintain order online for a number of reasons. In 1996, President Bill Clinton pushed forward the Communications Decency Act aiming to regulate Internet obscenity, although the Supreme Court would rule it unconstitutional. American regulators tie themselves into knots chasing online gamblers and their online dealers. In the Internet?s early stages, the French government took Yahoo to court because the Web site allowed a user to advertise the sale of Nazi memorabilia, a crime in the European state. In the midst of trade negotiations, including the current Korea-U.S. free trade agreement sitting in Congress and the National Assembly, upholding copyright standards is a critical pillar of bilateral business, prompting agencies to block domain names and pressure search engines.

But in open societies, governments have generally been careful not to encroach on the right to remain anonymous online. There are ways to track down who is behind online activity, when necessary, and these digital footprints are becoming easier to detect. But for the most part people feel they can preserve their anonymity online if they so desire?a prerogative that is both a blessing and a curse. The comments pages under any semi-controversial YouTube video reveal the discouraging reality of Internet anonymity. Yes, there may be dissident and whistle-blower bloggers unveiling corrupt practices under pseudonyms here and there, but there are also plenty of intolerant seventh graders availing themselves of such anonymity to harass Facebook pages devoted to celebrating Ramadan.

Korea?s attempt to chisel away at the sanctity of online privacy would not be as effective in nations that are more reliant on outside Internet businesses integrated into a global community. Facebook?s enormous presence in Indonesia, for example, affords that country?s government less latitude to dictate how Indonesians engage social media than if it were dealing primarily with Indonesian sites.

But even the Korean experience has proven the limits of centralized Internet control. As the government requires real names for major Korean Web sites, young users flock easily to foreign-based sites where they can remain anonymous. YouTube Korea prohibits users from uploading or commenting on videos while their location is set on YouTube settings. However, anyone in South Korea can click on the ?geography? tab on the U.S.-based Web site and change their location to California. Cyworld?s strict policies are noted as a major cause of Facebook?s increasing market share.

The latest cyber attacks have magnified the problems inherent in a real name verification system. Last month, Cyworld?s parent, SK Communications, became the first Korean Internet company to declare it will no longer require extensive information to open accounts, and said it plans to destroy its current database that was accessed by the July hackers. While trends suggest greater corporate and governmental control of the Internet in the 21st century, the Korean experience will make future policy makers think twice about eliminating anonymity from the Web.

Netflix snatches DreamWorks rights from HBO (AP)

SAN FRANCISCO ? Netflix unveiled a coming attraction its subscribers might like for a change: the Internet video rights to films and television specials from DreamWorks Animation.

The multiyear deal announced Monday will give Netflix Inc.'s streaming service the exclusive rights to show the latest content from DreamWorks, the studio behind a list of popular franchises that includes "Shrek," "Kung Fu Panda" and "Madagascar." But the rights don't kick in until 2013. So, the DreamWorks material won't immediately placate Netflix customers who are clamoring for Netflix's streaming library to widen its selection of box office hits.

The complaints could escalate early next year when Netflix loses the streaming rights to Walt Disney Co. movies and other films that it got through a licensing deal it had with Starz Entertainment.

Still, the DreamWorks deal represents a badly needed coup for Netflix, which has been reeling from a customer backlash triggered by sharp price increases and an upcoming spin-off of its DVD-by-mail service into a website called "Qwikster."

Netflix snatched the DreamWorks Animation SKG Inc. rights from pay-TV rival HBO, providing the latest sign that Internet video has emerged as a compelling ? and lucrative ? alternative for Hollywood movie and TV studios.

Although the financial terms weren't spelled out, DreamWorks CEO Jeffrey Katzenberg left no doubt that Netflix is paying his studio more than Time Warner Inc.'s HBO currently is. "This arrangement allows us to get more value for our content while giving us a greater degree of flexibility in how we distribute it across multiple platforms in today's evolving digital world," Katzenberg said.

The rising cost for streaming rights is the main reason that Netflix recently increased its prices by as much as 60 percent for U.S. customers who want both DVDs and Internet video.

Netflix, which is based in Los Gatos, Calif., is counting on the higher prices, which kicked in earlier this month, to bring in the additional revenue it needs to keep adding more titles to its streaming library. The strategy could backfire if too many subscribers upset by the higher prices cancel their service; Netflix already has said it expects to end this month with 600,000 fewer U.S. subscribers than it had in June when the total stood at 24.6 million.

Locking in DreamWorks as an exclusive deal also was important to Netflix, too, because it's facing tougher competition in Internet streaming.

Amazon.com Inc. one of Netflix's most formidable rivals, expanded its streaming service Monday with the addition of TV shows and movies from News Corp.'s 20th Century Fox studio. Most of the TV shows that Amazon is picking up from Fox already are can be streamed through Netflix. In a notable exception, Amazon will have "The Wonder Years," a coming-of-age TV series from the 1980s and 1990s that is only available on DVD through Netflix.

Amazon says its streaming service now has more than 11,000 titles, doubling the total it had when it started seven months ago. Netflix's hasn't specified how many titles are in its streaming library, but an analysis done last month by another rival, Dish Network Corp., found nearly 32,000 selections.

Amazon includes unlimited video streaming as part of another service, called "Prime," that provides free and discounted shipping to the Internet merchant's customers. Prime costs $79 per year, slightly below the $96 annual subscription for Netflix streaming.

The next logical step for Amazon would be to buy Netflix's streaming service, according to Wedbush Securities analyst Michael Pachter. He thinks Netflix is spinning off its DVD-by-mail service primarily to make its streaming service more attractive to Amazon.com. Netflix's plummeting stock price has made a takeover bid more affordable too. Since the company announced its higher prices in mid-July, Netflix's stock price has lost more than half its value.

In a Sept. 22 research note, Pachter predicted Amazon would pay up to $7.2 billion for Netflix's streaming business. That would translate into about $130 per share.

Both Netflix and Amazon declined to comment on the speculation.

The? four-hour lunch with splendid wines had ended, and the group for which I had been responsible for a week was finally off duty. My wife and I settled into a cafe table on the plaza in front of the Sant Celoni Town Hall and tried to remember if we had ever seen a town hall in America with cafes and boutiques around a paved perimeter in front of it, teeming with playing children and elegant strollers. We were ten kilometers inland from the Costa Brava, and at 9:00 p.m. the local Spaniards were just heading for dinner.

A waiter set down a carafe of white wine in front of us but asked if we preferred rose or red or something else. I told him the white would be fine but asked what it is. He shrugged and said it was from near Arenyes, a short distance away.? As he walked away, a soccer ball bounced off my leg and was retrieved by a breathless ten-year-old issuing a breathless apology. The clock chimed the quarter hour ? 9:15 p.m., and I thought of rural Indiana where no child would be kicking a soccer ball around a town hall at that hour (or probably not at any hour), certainly not in proximity to where their parents and other adults would be consuming alcoholic drinks.

Next day, at lunch in Argeles-sur-Mer on the French side, from our table we could look across a 100-meter sandy beach at the Mediterranean and at dozens of families gathered round for a Sunday lunch. Again, the wine flowed while children banged their games around the tables and chased their dogs in and out of the dining area.The young lady who brought the carafe of rose I had oredered had no idea what grape had made it. It came from Collioure, one of the next towns along the sea, and that was good enough for her. What mattered to us was that it was a good match for the mussels in a garlic-cream broth seasoned with saffron.

What also mattered was the lack of seriousness about the wine, the food, and the setting. For a week I had delved into what went into the wines we were experiencing, growing seasons, aging processes, and marketability. Last night and today I re-learned that wine is a food, an agricultural product to enhance our meals and help us reflect on life?s blessings. Children at play around cafe tables bearing one of God?s gifts? Let someone else worry about that. The citizens along the French-Spanish border where the Pyrenees end their southward march live long and happy lives. They would rather enjoy their food and drink than write about it. Even so, I clutched my week?s notes tightly, fearful that I might yield to the spirit and cast them away. I am after all, a child of the work-ethically-driven rural Midwest.

But prosecutors say the recorder captured something entirely different: the officer murdering a defenseless man suffering from schizophrenia.

Police agencies across America are increasingly using audio and video devices to collect evidence, and they played a crucial role in prosecutors bringing murder charges this week against Ramos and an involuntary manslaughter count against a colleague, Cpl. Jay Cicinelli.

The violent encounter with Kelly Thomas was captured on surveillance video, but prosecutors say it was only when they paired the images with police audio that they understood what they were seeing. They said Thomas was pummeled, shocked with a Taser, beaten with a stun gun and taunted by Ramos as he stood over the victim and declared: "Now see my fists? They are getting ready to F you up."

Orange County District Attorney Tony Rackauckas called that statement ? and the fact it was recorded ? a turning point.

"This encounter had changed from a fairly routine police detention into an impending beating at the hands of an angry police officer," Rackauckas said. "Ramos instilled in the victim a reasonable fear that his life was in danger."

Fullerton uses a device sold by Riverside-based Versatile Information Products Inc., which contracts with electronics-maker Olympus to customize standard digital voice recorders.

At the end of each shift, officers transfer files onto a server that backs them up as long as needed. The devices, used by hundreds of police agencies, do not let officers edit files, and they show if anything has been deleted.

Device salesman Stephen Gaskins said the units cost about $300 a piece, with the software to back up the files available separately.

"Expensive, but not as daunting as what lawsuits cost," Gaskins said, referring to the frequency the devices provide evidence to exonerate officers wrongly accused of misconduct.

About 700 other police departments across America have gone a step further, equipping officers with tiny body cameras to record interactions.

In Oakland, where the department is under federal supervision following a case where four officers were caught planting drugs on suspects, police supervisors view the cameras as a useful extra check on officers.

The Los Angeles Police Department is spending $20 million to install video and audio systems in its squad cars. Officers will be wirelessly miked and a computer starts recording every time the emergency lights are activated.

Even before Fullerton police started using audio recorders, the department employed dashboard video cameras and microphones, but these proved unreliable, Sgt. Andrew Goodrich said. Recorders are now standard issue and officers are taught to switch them on every time they interact with a member of the public.

"In just about every investigation that goes to court, one of the common requests is that (prosecutors) want the (audio)," Goodrich said.

In Los Angeles, after some initial concerns private conversations between officers would be recorded, the police officer's union has embraced the technology.

"In the vast majority of cases, the public is going to see the police officers being very restrained and very professional, and that's a positive," Los Angeles Police Protective League president Paul Weber said.

Another piece of high-tech evidence came from Cicinelli's Taser. By downloading information on the weapon, investigators determined he used it three times in "drive stun" mode, pushing the device directly into Thomas. Then he used it a fourth time, firing darts from weapon and shocking Thomas for about 12 seconds.

Cicinelli then allegedly smashed Thomas about the face with the Taser. Cicinelli's attorney Bill Hadden said he had not received any discovery in the case but claimed prosecutors had gotten a lot of facts wrong. He said he would be making a fuller response in the coming weeks.

Ramos's attorney, John Barnett, has disputed prosecutors' account of the confrontation with Thomas. He says when his client made the threat about his fists, he was using a subtle type of force to get a suspect to comply. Ramos was responding to a transit hub in the suburban college town after someone reported seeing a homeless man breaking into cars.

In all, six officers were at the scene but the other four were not expected to be charged. Cicinelli's device and that of one other officer were not activated, though police say it's not unusual for an officer to forget to switch on the mechanism if they are responding to an unfolding emergency.

Officers kill mountain lion that clawed Idaho boy (Reuters)

SALMON, Idaho (Reuters) ? A mountain lion that killed a family's dog and clawed a young boy near Boise, Idaho, has been killed by Idaho wildlife officers, authorities said on Friday.

The 10-year-old boy and his father came face-to-face with the cougar while out on Thursday night searching their rural subdivision northeast of the state capital for their missing pet, Idaho Fish and Game Department officials said.

Officers said the boy panicked and ran, triggering the lion's chase response. The boy stumbled, and the cat swiped him with its front paw, scratching the child on the arm and hand. The boy's father scared the cougar away by firing his handgun.

Idaho conservation officers used tracking dogs to corner the female mountain lion, found guarding the dog it had killed earlier, and they gunned down the cougar with a rifle and pistols, authorities said.

Wildlife officials said the cougar was 18 months old and weighed roughly 50 pounds.

Matt O'Connell, senior conservation officer with Fish and Game, said the incident marked only the second occasion ever recorded in Idaho in which a mountain lion injured a person. The other case involved a 12-year-old boy on the Salmon River in the early 1990s.

"It is not unusual for young lions to get into trouble after they have left the protection of their mother and are trying to learn to survive on their own," O'Connell said in a statement.

Officials said it was protocol to kill lions that have made physical contact with humans, even though Thursday night's attack on the boy caused only minor wounds.

The mountain lion, hunted as a big-game animal in Idaho, is the largest cat in the Northern Rocky Mountains. Cougars prefer rugged, sparsely populated mountainous areas, with their numbers highest in Western states, according to researchers at Idaho State University.

In 1989, a man came to my office and introduced himself as the vice president of development for the Del Webb Corporation.? He retained my firm to prepare a master plan for their first active-adult community outside of their typical desert southwest market.?

This led me to an exploration of what made a successful active adult community.? I learned they required unique and distinct considerations quite different from those used in more conventional master planned communities.? During the information gathering process, I toured each of the Sun City projects, interviewing staff and visiting residents to understand the qualities and features which attracted buyers and provided the lifestyle sought by retirees.?

Since that initial project, I and my partners have had the opportunity to plan and design over 60 active adult communities, many of which were realized and built out over the past 10 years.? We have also worked with existing active adult communities to expand or enhance their amenities and programming to remain relevant to the changing needs of the boomer resident and buyer.

Over the past several years, our firm began working with small towns and rural communities utilizing our insight and knowledge of the retiree market and desired community amenities to create or enhance their position as a retirement destination.? Additionally, we have assisted them in establishing programs to recruit retirees as an economic development strategy that taps into economic, social, educational and professional attributes of the boomers.?

Through my work with both the active adult and rural/small town communities I have observed changing trends in the retiree market as the Eisenhower generation gave way to the boomers.? The following are some of the patterns and behaviors which are vital to the boomer home buyer as they make decisions on their retirement living.

Trend 1 ? When making a decision regarding retirement housing, boomers are savvy consumers, typically having purchased between 3 ? 9 homes in their lifetime. ?These are buyers who know what they want and are reluctant to compromise their selection criteria.

Trend 2 ? Recreation preferences have shifted significantly over the 35 years I have worked in this market.? In the late 80s, virtually all active adult communities relied on golf as the primary community amenity. ?Now golf ranks 8th as the preferred amenity of retirees and continues to decline in popularity.? Walking facilities are by far the most requested amenity in retiree focus groups followed by fishing, bocce, tennis and pickleball.

The size of individual dwellings is smaller but still well constructed and featuring no reduction in amenities.? However, specialty rooms are being replaced by multi-use space.? My favorite analogy is the comparison of a Cadillac to a BMW.? There is also increased demand for design and construction techniques which enhance the conservation of water, electricity and natural gas.

Trend 4 ? Community size is smaller, ranging from 10,000 to 2,500 units.? The trend now reflects a growing demand in the market for smaller, more intimate communities.? Finance and entitlement issues further support this trend.

Trend 5 ? 65% of boomers desire to continue their education through formal and informal means during retirement.? This preference drives the decision to purchase a home in towns with a college or an established academic program.? Communities which do not have higher learning institutions have brought in private education, on-line and community educational entities.? The requirement for connectivity is also complicating this trend.

Trend 8 ? Boomers are not flocking en masse to multi-family dwellings in urban cores.?
